The Agreement Governing Your Use of néMOTTI & Your Purchases

Welcome to néMOTTI. These Terms & Conditions (the "Terms") govern your access to and use of the néMOTTI website at nemotti.com (the "Site"), operated by Hejazian Global Group Tekstil Ticaret Limited Şirketi, and set out the basis on which we sell our products to you. Please read them carefully.

Acceptance of These Terms

By accessing the Site, placing an order, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms, together with our Privacy & Data Notice and our Mesafeli Satış Sözleşmesi (Distance Sales Agreement), which are incorporated into and form part of this agreement. If you do not agree to these Terms, please do not use the Site or place an order.

Article 1 — Intellectual Property

All content on this Site — including but not limited to designs, photography, text, logos, and the néMOTTI name and mark — is the property of Hejazian Global Group Tekstil Ticaret Limited Şirketi and is protected by applicable copyright and trademark law. No content from this Site may be copied, reproduced, distributed, or used commercially without our prior written consent.

Article 2 — Products, Pricing & Availability

We make every effort to display our products and their details accurately, including color, fabric composition, and sizing. Slight variations may occur due to photography, lighting, or screen display. All prices are listed in Turkish Lira (₺) unless a different currency is selected via the on-site currency switcher, and are subject to change without prior notice; however, the price charged will always be the price displayed at the time your order is confirmed. We reserve the right to limit quantities, discontinue products, or correct pricing errors, and will notify you if this affects an order you have already placed.

Article 3 — Orders & Payment

By placing an order, you are making an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud or stock unavailability). Payment is processed securely at checkout through encrypted, PCI-compliant payment gateways; we do not store your full payment details on our servers. An order is only confirmed once you receive an order confirmation email.

Article 4 — Shipping & Delivery

Full details on processing times, delivery estimates, shipping costs, and customs responsibilities are available on our Shipping & Delivery page. By placing an order, you agree to those terms as part of this agreement.

Article 5 — Returns & Right of Withdrawal

You may withdraw from your purchase and return eligible items within 14 (fourteen) days of delivery, in accordance with our Mesafeli Satış Sözleşmesi (Distance Sales Agreement), provided to you at checkout and by email with every order. Certain items — including made-to-order and personalised pieces, and goods with a removed hygiene seal — are excluded from this right by their nature. Article 6 — Privacy & Data Protection

Your personal data is processed in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK). Details on what data we collect, why, how it is used, and your rights as a data subject are set out in our Privacy & Data Notice, which forms part of these Terms.

Article 7 — Limitation of Liability

To the fullest extent permitted by law, néMOTTI and Hejazian Global Group Tekstil Ticaret Limited Şirketi shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or your purchase of our products, beyond the value of the order in question. Nothing in these Terms limits any statutory rights you hold as a consumer under Turkish law that cannot lawfully be excluded.

Article 8 — Prohibited Uses

You agree not to use this Site to:

transmit any unlawful, harmful, or fraudulent content;
attempt to gain unauthorized access to our systems or another user's account;
interfere with the Site's security or normal operation; or
use automated means (bots, scrapers) to access or extract data from the Site without our written permission.

Article 9 — Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Any dispute arising from these Terms or your purchase shall first be subject to the mandatory mediation (arabuluculuk) requirement under Turkish Law No. 6502 on the Protection of Consumers, and thereafter may be brought before the competent Consumer Arbitration Committee (Tüketici Hakem Heyeti) or Consumer Court (Tüketici Mahkemesi) in Turkey, depending on the value of the dispute, as prescribed by applicable legislation.

Article 10 — Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. The version in effect is the one published on this page at the time of your visit or order. We recommend reviewing this page periodically.
